A/E/C Strategy provided expert consulting services to the project architect/engineer and its counsel in evaluating claims asserted by the construction contractor. The allegations include owner directed changes, deficient plans and specifications as well as impacts from performing out-of-scope work related to major structural systems. The contractor’s claim includes direct cost, delay damages and cost of construction acceleration. Ski Resort – Idaho
An international group of developers embarked on building a 3,600 acre, four-season destination resort in Southwest Idaho. A consultant was retained to prepare preliminary designs and process various local, state and the federal permit applications for Planned Unit Development (PUD), wetlands mitigation, storm water management, etc. After nearly three years of submittals and revisions, and an expenditure of over $4 million, the lead consultant was unable to secure any of the required permits. A review of the consultant’s performance including an audit of its billing records was performed to support developer allegations of negligence and over billing by the consultant. The findings were presented in pretrial mediation and formed the basis of the negotiated settlement. |
